TERMS AND CONDITIONS

This English version is provided for information. In the event of discrepancies, the German version shall prevail.

1. Scope and commissioning
These terms apply to testing, inspection, engineering and related services provided by FAKT GmbH. The scope is defined by the accepted quotation or written order. Changes and additional services require agreement and may be charged separately.

2. Customer obligations
The customer must provide all information, documents, specimens and vehicles required for proper performance and disclose relevant hazards. Delays or additional costs caused by incomplete or incorrect information may be charged to the customer.

3. Performance, deadlines and results
FAKT GmbH performs services in accordance with the agreed procedure and recognised technical rules. Dates are binding only if expressly confirmed as such. Test reports and results relate solely to the specimens and conditions tested.

4. Remuneration and cancellation
Fees and expenses are based on the quotation or applicable price agreement. In the event of cancellation, FAKT GmbH may charge services already performed and costs incurred. Saved expenditure may be taken into account at a flat rate of 30%.

5. Liability
Liability is governed by German law and the limitations stated in the German contractual version. The customer remains responsible for use and interpretation of results outside the agreed purpose.

6. Confidentiality, copyright and data protection
Business information and trade secrets are treated confidentially, subject to statutory duties and obligations towards designation or accreditation bodies. The customer receives a simple, non-transferable right to use reports, results and calculations for the agreed purpose. The FAKT name or trademark may be used only with complete, unaltered documents. Personal data is processed using appropriate safeguards.

7. Statements of conformity
Where no different decision rule is specified, FAKT GmbH applies “Simple Acceptance Criteria” with indirect consideration of measurement uncertainty. Pass means the measured value is below the acceptance limit; fail means it is above the acceptance limit. Any different procedure is stated in the relevant method or report.

8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Memmingen and the place of performance is Heimertingen.
